Successful Defense of Claims for Breach of Fiduciary Duty
Nicholas R. Caputo, and David M. Blumenthal of Robinson Brog recently obtained summary judgment on behalf of its client, dismissing an action brought by Washington Title Insurance Company in the case of Washington Title Insurance Co. v. Sand Lane Title et al. Washington Title had sued Robinson Brog’s client for damages associated with Defendant Sand Lane title agency’s relationship with Washington Title. Washington Title alleged to have suffered damages resulting from monies that were collected by Sand Lane at closings that were not used to pay recording tax and other title expenses. The Court dismissed the claim against Robinson Brog’s client on the basis that it had not signed the underwriting agreement with Washington Title and therefore all of the claims, including claims for breach of fiduciary duty, and aiding and abetting breach of fiduciary, were dismissed.
