Robert M. Milner is a partner and member of the Litigation Department and his practice crosses multiple disciplines.  His practice focuses primarily on corporate, commercial, real estate, construction, and estate litigation, as well as transactional work in the construction industry.

He has litigated in the state and federal courts and before the American Arbitration Association, primarily in the fields of construction, complex real estate matters, corporate and commercial litigation, and employment matters relating primarily to restrictive covenants.

In the real estate field, Mr. Milner has litigated numerous adverse possession cases, in addition to a wide variety of other real estate litigation involving brokerage transactions, commercial leasing, co-op litigation, partnership disputes and the like.

Among his recent activities are the following:

  • Successfully secured preliminary injunctive relief overturning the denial of the right to exercise of real estate options
  • Concluded ten days of  arbitration hearings representing the president of a hedge fund who sued for breach of contract and defending claims for fraud
  • Successfully secured bifurcated summary judgments on liability alone for breach of the covenant of good faith and fair dealing and for tortious interference with contract in an action involving the sale of two mixed use buildings
  • Secured the dismissal, within weeks of commencement, of an action seeking to enforce a restrictive covenant against a former employee

A graduate of Hobart College in 1961, Mr. Milner received his LLB from New York University Law School in 1964.  He joined the firm as a partner in 1980.  He is a member of the bars of the State of New York, the United States District Court for the Southern and Eastern Districts of New York, the Second Circuit Court of Appeals, and the United States Supreme Court.
