David M. Blumenthal is a partner in the Firm and a member of its Executive Committee. Previously, Mr. Blumenthal was the managing partner of Schekter Rishty Goldstein & Blumenthal, P.C., a midtown law firm which merged its practice into the Firm in January, 2001.

Mr. Blumenthal's practice focuses on complex commercial and civil litigation in Federal and State courts. The subject matters include all types of commercial and business related litigation, including stockholder derivative actions, partnership disputes, and commercial real estate litigation. In addition to his litigation experience, Mr. Blumenthal has significant transactional experience in corporate law, licensing and commercial real estate leasing. Generally, he represents business and commercial real estate clients with overlapping litigation and transactional needs interfacing with their ongoing businesses and investments.

Mr. Blumenthal has litigated several significant reported cases, including: Gottlieb v. Greco, 298 A.D.2d 300, 749 N.Y.S. 2d 19 (2002) (representation of an attorney in a dissolved law firm partnership whose primary practice concerned condemnation law compensated on a contingency fee basis. Holding allowed law partner to form a new firm and represent most of clients of prior firm with attendant fees); Jemaltown of 125th Street, Inc. v. Leon Betesh/Park Seen Realty Associates, 115 A.D.2d 381, 496 N.Y.S. 2d 16 (1985) (landmark Appellate Division decision establishing the standards for a Yellowstone injunction in New York in commercial landlord/tenant matters. Where a commercial tenancy was threatened by a landlord's notice of default, which notice tenant disagreed with in whole or in part, the court found traditional injunctive relief standards do not apply to Yellowstone injunctions and allowed for a less stringent standard and easier burden for tenant to meet); Benun v. Allstate Insurance Co., 225 F. 3d 645 (2000) (Second Circuit affirming a verdict reached at jury trial in the Southern District of New York in favor of our client against Allstate where a rare Porsche automobile was stolen and its theft was improperly not covered by All-State. Plaintiff received full value of automobile with interest (as opposed to cost of repair), plus return of recovered automobile; Citibank, N.A. v. Simpson v. Circle Consulting Group, Inc., 290 N.J. Super. 519, 676 A.D.2d 172 (1996) (New Jersey Appellate decision establishing the basis for territorial presence in the forum as a basic prerequisite to subjecting defendant to in personam jurisdiction. Case set the standard for analysis of the minimum contacts test in the State of New Jersey and whether or not a party with a limited presence in the state is subject to its jurisdiction; Forty-Seventh-Fifth Company v. Nektalov, 225 A.D.2d 343, 638 N.Y.S. 2d 625; Subkoff v. Broadway-13th Associates, 139 Misc. 2d 176, 527 N.Y.S.2d 147 (1988).

Mr. Blumenthal's transactional experience includes representation of various licensees in license agreements with well-known owners of trademarks such as Calvin Klein, Disney, Apple Bottoms, National Basketball Association, World Wrestling Federation, MGA/ Bratz, Outkast, Nickelodeon and JNCO, among others. Mr. Blumenthal also has extensive experience in the trucking industry, representing one of the largest inter and intra-state trucking companies in New Jersey.

Mr. Blumenthal is admitted to practice law in the States of New York and New Jersey. He is admitted in the United States District Court for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Second Circuit as well as the District of New Jersey. Mr. Blumenthal graduated from Pace University School of Law in 1981 where he was a member of Moot Court, receiving Best Oral Argument. He is listed in Who's Who in American Law and is an AV rated attorney by Martindale- Hubbell, the highest rating available to attorneys. Mr. Blumenthal is member of the Bar of the State of New York. He is a member of Commercial and Federal Litigation Committee of the New York State Bar Association and has sat on the Complex Commercial Litigation Subcommittee.

Mr. Blumenthal is active in his community and was a long-term member of the board of directors of the Rockville Centre Basketball League, with over one-thousand student athletes (Grades 3-12). Mr. Blumenthal was a recipient of the prestigious Michael Reilly Award, given to a person with at least five years of continuous service to the community and extraordinary contributions to the basketball league. He was a member of the Recodification Committee for the Village's Ordinances and Zoning laws and was the campaign manager for a Village Trustee and Village Justice, respectively. Additionally, Mr. Blumenthal serves as a member of the Rockville Centre Zoning Board. Mr. Blumenthal has been a guest lecturer at Nassau Community College on issues of law and paralegal recruitment.
